Islamabad: The federal government’s proposed draft for the 27th Constitutional Amendment has been revealed. It explains which articles of the Constitution will be changed and what new ideas are being suggested.
According to the details, the amendment includes possible changes to Article 160 (Clause 3A), Article 213, Article 243, and Article 191A, along with several other clauses.
Sources say the proposal is a comprehensive constitutional package that aims to bring big reforms in the judicial system, the financial distribution system, and the balance of power between the federation and provinces.
This development came after a meeting led by Prime Minister Shehbaz Sharif, where he asked Bilawal Bhutto Zardari and Asif Ali Zardari to support the amendment’s approval.
Main Points of the Proposed Changes
1. End of NFC Award’s Constitutional Guarantee (Article 160 & Clause 3A)
The proposal suggests removing the constitutional guarantee that gives provinces a fixed share of federal revenues. This change could affect the autonomy that provinces gained after the 18th Amendment.
2. Major Changes in the Judicial System (Article 191A and New Article)
A new Constitutional Court may be created to handle constitutional matters, changing who has the final authority on constitutional interpretation.
Amendments are also planned for Article 200 regarding the transfer of High Court judges.
3. Shifting Powers from Provinces Back to Federation (Schedules 2 & 3)
The proposal suggests bringing education and population planning back under federal control — areas that were earlier managed by provinces after the 18th Amendment.
4. Military Command and Federal Authority (Article 243)
The amendment includes changes to keep the command of the armed forces completely under the control of the federal civil government.
5. Appointment of the Chief Election Commissioner (Article 213)
The selection process for the Chief Election Commissioner may be changed to avoid political deadlock between parties.
According to sources, the government has shared the draft of the 27th Constitutional Amendment with the Pakistan People’s Party (PPP). After consulting coalition partners, the final draft will be presented in Parliament.
PPP Chairman Bilawal Bhutto Zardari confirmed that the Central Executive Committee meeting will be held on 6 November, chaired by Asif Ali Zardari, to make a formal decision about the amendment bill.
To pass the constitutional amendment, the government needs a two-thirds majority in both houses of Parliament, making the PPP’s support crucial for the success of this major legal change.
